Latest developments on the Medium Combustion Plant Directive (MCPD)
In January 2016 FIRA advised members' that a new Directive (EU 2015/2193) on the limitation of emissions of certain pollutants into the air from medium combustion plants was due to come into effect.
At the time, the implementation of this Directive seemed a long way off. However, its impact is now fast approaching and Government has recently published the draft statutory instrument for transposing the Directive and introducing emission controls for certain generators in England and Wales; entitled the Environmental Permitting (England and Wales) (Miscellaneous Amendments) Regulations 2017.
This draft legislation will be laid before Parliament and the National Assembly for Wales together with the supporting impact assessments, ahead of the transposition deadline for the MCPD in December.
FIRA’s advisory document summarises key issues appertaining to the Directive. In addition the Department for Environment Food and Rural Affairs (DEFRA) has provided a summary of answers to frequently asked questions such as:
When will the Directive come into force? Who will be responsible for the regulation of MCPs? Does the enforcement date vary for new and old equipment?
